  • 1. I have sold my boat and want to bring in a bigger boat. What is marina Policy on this?

    At the moment the policy of Creek Developments plc regarding changing of yachts with a berthing facility at the marina is the following: 

    Creek Developments plc will only guarantee the same berthing  facilities as the existing boat under contract in the marina, as long as the size of the new boat is the same or smaller. 

    In cases where the owner persists in replacing the boat with a new replacement boat which is bigger than the one in the marina, Creek Developments plc will put the new boat on a waiting list until the appropriate berth for the boat becomes available. 

    Until such time the boat will be on a temporary basis.

    If the yacht is berthed at the marina on an annual contract, AND the old owner does not wish to keep the berth for a new yacht, the old owner may sign a declaration that he has sold his yacht to you and no longer requires the berth. Creek Developments plc will then cancel the annual contract with the old owner and draw up a new annual contract with the new owner. The new owner will pay the remainder of the annual berthing fees.

    If the old owner has sold his yacht because he wishes to buy a new one, and he wishes to berth his new yacht under the annual contract, then the new owner will be buying the yacht on the express understanding that it is berthed on a temporary basis in the Marina.

  • 3. What documents are required to carry out the transfer of the Berthing Licence Agreement?

    You will need to bring copies of the following documents:

    • The bill of sale for the yacht
    • Registration in the new owner’s name
    • Insurance in the new owner’s name
    • A copy of your ID card or passport
    • If the boat is to be owned by a company, a copy of the memorandum and Articles of Association
  • Then, the previous owner must sign a declaration at the Marina Office that he has sold the yacht and does not wish to keep the berthing facility, but the new owner would like to carry on berthing the yacht in the Marina. The new owner signs the same agreement and the transfer is complete.
  • Note that no transfers can take place until all outstanding accounts are settled.
  • 4. I have bought a yacht that has been berthed for the last three years on a temporary basis in the Marina. May I continue to keep the yacht in the marina?

    Yachts berthed in the Marina on a temporary basis, even over a long period, do not have an assigned berth in the Marina. For as long as sufficient berths are available, the Berthing Master will allocate a temporary berth for the yacht. However, it must be understood that a yacht berthed on a temporary basis, will be subject to shifting, possibly very frequently, and at short notice. It is likely that during the summer months, temporary boats will be moved to Pieta Quay, and may even be requested to leave the Marina altogether, should space no longer be available. Yachts berthed on a temporary basis are not guaranteed a berth in the Marina and are consequently invoiced at the end of each month.

  • 5. I would like to sell my old boat and purchase a new one. May I keep my annual berth in the Marina?

    Anyone wishing to change boats is advised to write to the Berthing Master BEFORE making any final decisions, specifying the size, particularly the beam, of the prospective new yacht. Due to space restrictions, current Marina policy is that if the new boat is the same size or smaller than the old one, there will be no problem with berthing the new yacht in the old berth.

    If the new yacht is larger, in particular beamier, even by a very small amount, then, as long as space is available, the new yacht would be berthed in the Marina on a temporary basis, until such time as a suitable annual berth can be found for the yacht. If a suitable berth is found, a new annual contract will be signed for the yacht, but owners should be aware that berths for larger yachts are limited and there is no obligation on the part of the Marina to allocate a new berth within a specific time frame, or at all. The annual berth for the smaller boat must be relinquished, before the new yacht is brought into the Marina.

    The final decision as to whether a yacht fits a berth, rests with the Berthing Master, who will consider not only whether the yacht physically fits the space, but whether the berth is still safe, and whether any inconvenience is caused to the other boats already resident on the same pontoon.

    In all cases, the owner is advised to wait for a written confirmation from the Berthing Master before agreeing to buy the new yacht.

  • 6. One of the ropes on my berth appears to be missing, what should I do?

    If any ropes are damaged or missing, please contact the Marina office immediately. The rope will be replaced during the next rope replacement session. If the damaged rope leaves the yacht in a dangerous position, please inform the Marina Office, so that the yacht can be secured temporarily until the change of the ropes.

  • 7. The ropes on my berth are very heavy, can they be replaced?

    When ropes are in the water for long periods, heavy encrusting growth may make them very heavy and hard to handle. If there is a large amount of encrusting growth on the ropes, they will be replaced. However, if the ropes are deemed to require only rinsing, but you would prefer them to be changed, a charge of €75 will be made for each rope.

  • 8. Do I need to be present when ropes are being replaced?

    The owner does not need to be present when ropes are being replaced, but should be aware that it is usually necessary to board the yacht in order to replace ropes. Hence, owners who wish to be present should enquire about the work schedule at the Marina Office. Owners choosing not to be present, imply by their absence that they consent to the Berthing Master or the Marina Assistant boarding the yacht in order to carry out the work.
